Outkast may be gaining some ground in the upcoming court case against them as a federal court judge puts Rosa Parks on the spot. Judge Donald A. Scheer ordered a doctor for Rosa Parks to explain why she will be unable to testify in the lawsuit that she brought against Outkast and BMG Record company.
Lawyers for the defense have requested an interview with Rosa Parks to explain how she suffered emotional and mental stress when Outkast said her name in the song titled “Rosa Parks”. The judge has also removed Outkast from the lawsuit because their individual names were not mentioned and the spelling of the group’s name was incorrect. The 91-year-old Parks brought the lawsuit against Outkast in 1998 also claiming that the song interfered with ongoing business, which the judge later threw out. Rosa Parks is seeking to have her name removed from future versions and monetary damages. A jury trial will begin on Jan 10, 2005.
