Nicki Minaj Doesn’t Think She Owes Tracy Chapman Anything For Leaked Nas Track

    Nicki Minaj is reportedly convinced she did nothing wrong by using Tracy Chapman’s music without permission. According to The Blast, court documents show Black Barbie is denying all of Chapman’s allegations.

    The veteran singer-songwriter claims Nicki stole her 1988 song “Baby Can I Hold You” for her own track “Sorry” featuring Nas — despite failing to secure the rights. Nicki admits her team repeatedly asked for Chapman’s permission and was denied. However, she recorded the song anyway.

    The sample clearance issue was partly to blame for the delay of Nicki’s latest album, Queen. The Queens-bred rap star wanted to include “Sorry” on the album, but because she couldn’t clear the sample, she ultimately left it off.

    The song was eventually leaked to Funkmaster Flex who promptly threw it in rotation. Consequently, Chapman filed the lawsuit. 

    Nicki believes the use of Chapman’s sample was fair use and insists Chapman doesn’t own the copyright to the sampled track. She wants the entire lawsuit thrown out.

    2. Let me help the uneducated people that’s already in the comment section and those that are going to come after this. As long as Nicki isn’t collecting royalties from the leaked track she can’t get sued. It’s then look at as a promotional release and this case will be thrown out.

      1. Sigh, uneducated. She’s already being sued, what are you talking about? It’s in front of a U.S District Court and is moving forward, Chapman’s lawyers have asked for a jury trial. Nicki will settle because she likely has smart, expensive lawyers. Copyright infringement cases can award statuatory damages in US District Court, that is defined by law not by damages or actual harm caused.

You can not have not got your copyrights thru the Gov and poor man copy mail it to yourself or have the session file on your computer and have your lawyers request a Jury trial that’s not a big deal. She will settle if she wants to get it over with quick but if she wants to be petty she can fight it and have a big chance of winning. Yes sign uneducated sir.

        She can absolutely be sued. Does it make a lot of sense given that this song isn’t generating much revenue? Not really, since Chapman doesn’t stand to gain much from winning a case that grants her the right to claim royalties on a song that isn’t actually making money (probably not even enough to cover her legal fees).

        If Nikki ever performed the song though, that changes things. Or if this song indirectly leads to a massive increase in her wealth somehow.

        But this is America. She can definitenly be sued lol.

      3. Yes, she can. It’s called “unjust enrichment,” which means that she is enriching her career using Chapman’s work. Even if no cash is generated from the song directly, she is getting exposure and promotional value, which is valued in the millions of dollars, that enhances her image and increases her fame. Giving the song to one of the biggest hip-hop shows in the country and having him “put it in rotation,” is a massive source of regular and constant exposure for Nicki. IE, high-end advertising. If she stays ignorant and doesn’t settle the suite as she should, it will go to trial and her ignorance will cost her 5-10 times as much. Watch…
