A concert promoter is taking R. Kelly to court since the R&B star failed to perform on the agreed date and has not returned his compensation, TMZ reports.

The celebrity gossip site has spoke to the promoter, Darryl Austin, who booked Kelly for a show in Texas.

Austin claims he personally gave Kelly a $100,000 deposit to make sure he performed at a concert in Dallas during April.

Kellz’ management reportedly told Austin they were unaware Kelly was supposed to be performing in April. Austin says he has received $70,000 of the $100,000 he originally dished out to Kelly, but he wants all of his money to be returned.
