Diddy and his legal team have once again asked for a mistrial, claiming that the prosecution presented evidence they knew to be false.
Writing to Judge Arun Subramanian, defense attorney Alexandra Shapiro alleged the government had committed “prosecutorial misconduct”.
The letter reads: “In this trial the government has presented testimony that it knew or should have known was materially false related to its allegation that Mr. Combs dangled Bryana Bongolan from the balcony of Cassie Ventura’s apartment in September 2016.
“Accordingly, to avoid an unfair conviction in this case the Court should grant a mistrial.”
Shapiro continued: “The government knew or should have known this testimony was perjured, and that Ms. Bongolan could not possibly have been injured by Mr. Combs on a Los Angeles balcony in the early morning hours of September 26, or even the day before that.
“The government knew that he had stayed at Trump Hotel in New York City between September 24-29, 2016. In fact, the government had marked as GX7Y111 the records of this hotel stay, which are now in evidence. And it has had other evidence in its possession for some time showing Mr. Combs’s travel schedule and proving that he was on the East Coast when it told the jury he dangled Ms. Bongolan over a balcony in front of Ms. Ventura.”
The judge is yet to rule on the mistrial motion.
In her testimony, Bongolan claimed that Diddy stormed into Cassie’s apartment and dangled her over the balcony before he “slammed” her on furniture leading to injuries and emotional distress.
She has also previously filed a civil suit against Diddy over the alleged attack.
During cross-examination, Diddy’s attorneys attempted to cast doubt on Bongolan’s testimony, insinuating that she was lying about the incident.
Last week, it was revealed that Diddy paid $100,000 to obtain the security footage of himself assaulting Cassie in a hotel corridor.
In the Bad Boy mogul’s ongoing sex trafficking trial, Eddy Garcia, a former security guard at the InterContinental Hotel where the assault took place, began giving evidence.
Garcia told the court: “He said it had to be the only copy and that he didn’t want it getting out and if I was sure nothing was on the cloud.”
Garcia claimed that Diddy handed him an envelope with $100,000 inside.
The amount of money was split between three people with Garcia’s boss Bill Madrano receiving $50,000 with the other half split between two security guards.

Not going to happen in a million years. They’re half the trial and have invested way too many resources and too much money into this.
It’s not happening — but I understand them trying to find ways to get him a mistrial, because it’s not looking good for him on some of these charges.
