An Organization Accused Of Falsely Claiming Trademark Ownership Of The Word “Hip Hop”

    A Portuguese Hip Hop organization which goes by the name of the National Hip Hop Association (NHHA) may have a bit of explaining to do if allegations from a local writer are true.

    According to Joana Nicolau, a Portuguese Hip-Hop blogger and journalist, the organization claims to have trademarks from the National Institute of Intellectual Property for the following words: New School, Old School, Popping, Locking, BBoy, BGirl, New Style, Old Style, Beatbox, Street Dance, Hip-Hop, MC, DJ, Graffiti, and Breakdance.

    On top of claiming to have trademarks for the above words the NHHA are also charging those who wish to use any of the above words with a certification and licensing fee on top of requiring them to join their organization.

    But according to the National Institute of Intellectual Property, the word “Hip-Hop” is a collective association trademark meaning the word is not registered and is free for use.

    And the other Hip-Hop related words the NHHA is said to have trademarked are also not registered with the National Institute of Intellectual Property and are free for use.

    The NHHA has yet to respond publicly to reports of their questionable trademark ownership.

      1. I’m absolutely sure of the contents of this article. I confirmed everything with INPI, which contradicts the information on the website. The information on the website is misleading and deceiving.

        Yes, I write blogs (I said so to HHDX and I never claimed to do anything other than that) but I do confirm what I say.

        Plus, I wrote an email to ANH asking for clarification, which they didn’t provide yet. Either way, everything on this news article is true.

For me that site made me laugh but i understand that people worldwide must know this. Maybe this way the association members can really see how ridiculous they are creating this type of law.

      4. I got your point now. Yes i didnt gave too much value to the site too. And i knew they wouldnt go nowhere with this. And yes may be its the first time DX talk about Portugal and with a bad new, its a shame. But the Nicolau Main goal what not to talk bad about Portugal but to ashame the creators of the website. May be this isnt the right site to discuss this but i think its truly important for people outside Portugal know what some people try to do. I was not surprised at all with that association.     8. Artur, i totally understand what you are feeling but i don’t agree. Bad news travels fast but me, Nicolau, Bónus and Dark Sunn (Monster Jinx braaah braaah lol) know that there’s a lot of great things goin on in Portugal (Eurobattle is next week, u already talked about Diversidad..etc) and it’s a shame that Portugal comes to light with this kind of news. BUT honestly, I feel no shame. The shame is all and only of the ANH, or ANHH whateva … happened in Portugal, could happen anywhere else.

      If you, as a Portuguese, are willing to share this issue to the world is because you don’t agree. This may be sufficient to enlighten the people who read this site that Portugal is not with them… we just had the misfortune of that son of a bitch was born here.

Joana… I need you to understand one thing … the problem here is not you be talking / writing about the association … the problem is that we all know that this association could never do such a thing like ”arrest” the hip-hop. This culture does not even born in Portugal. Until the less intelligent person in the world would come to this conclusion …

      I honestly feel that the goal is to reach people outside the community, naturally uninformed, that may be willing to pay for the services of ANH.

    10. I understand everyone’s point of view and I just want to clarify the following: I DID NOT write to HHDX asking to publish news on this. I wrote to them to ask for an opinion on this issue and to ask if they had ever heard about any similar situation in other countries.

      Plus, I want to also let everyone know that I never claimed to be a journalist. That’s not my professional activity and I never said I was a journalist anywhere (you can also confirm this on my blog). I’m merely someone who likes Hip Hop and writes about it since 2003.

    11. I think it is quite an interesting situation to analyse, not just cause it’s ridiculous, but because it could probably happen anywhere.

      The terms ARE registered here. “hip-hop” is registered in one process, and a second process has all the other words registered together (not an individual registration per word).

      What “worries” me is that they are registered as “colective trademarks” normally available to associations. As an associations, and with the name trademarked, it can regulate comercial use of the words. Its quite useful for recognizing local products, like “Tapetes de Arraioles” (a type of carpet, característic of a town called Arraioles). The association that registered the term can regulate it’s use, especially preventing counterfeit products, and certifing products. Ridiculously, hip-hop was registered like that, to a “legitimate” association (as in judiciously legal, and not moraly/ethicly legal). For all that’s known, the poor lady that registered the terms might have no understanding whatsoever about the meaning of the words, thinking that they were tecnical terms… who knows.

      Now, can they enforce it? Doubt it… it seems just like too comun of a concept, and basicly NO ONE is going to even think about registering themselves. I mean, seriously… would you? lol

      Kinda makes me want to create an dance related association and register words like “tango”, “salsa” and “merengue”… talk about a hustle!
