According to the Associated Press, producer Carlos “Phantom of the Beat” Evans has filed
a $2 Million lawsuit ($1 Million in compensatory damages and $1 Million in
punitive damages) against Lil Kim, 50 Cent, Atlantic Records & Rotten
Apple Records, claiming they failed to pay royalties for the song Magic Stick (that sold two million
copies).
Evans claims that
he was contracted on Jan. 03 for a $7,500 advance and royalties for producing, engineering
and mixing the hit single. According to Evans,
Magic Stick was supposed to debut on 50 Cent’s album, Get Rich or Die Tryin’, but instead was released on Lil Kim’s La Bella Mafia album.
“It was one of the
hottest tracks on that album, and I didn’t collect my royalties,” Evans said. Who has also claimed to
have worked for Busta Rhymes, Ghostface & the Wu-Tang Clan.
In response, Rotten
Apple Records Lawyer Theodore Sedlmary, said the delay on the royalty
payment’s is being held up by a sample used (which had to be licensed and paid
for).
“Atlantic is trying to
get it straightened out … If after the accounting Mr. Evans is entitled to
anything, he’ll get it then,” says Sedlmary.
