Tory Lanez has just found out that his request to be set free while his lawyers sort out his appeal has been rejected — meaning he’ll have to stay behind bars.

Court reporter Meghann Cuniff received copies of the decision filed by the California Court of Appeal on Friday (October 27). According to the order, “appellant has not shown that the superior court unjustifiably denied relief.”

In other words, the Canadian rapper and singer couldn’t prove, based on his filings, that he wasn’t treated fairly by the court system — despite his repeated claims to the contrary.

The appeal for Tory Lanez’s release pending appeal was first filed back in August, shortly after the Sorry 4 What hitmaker received his sentence for the July 2020 shooting of Megan Thee Stallion.

According to court reporter Meghann Cuniff — who has been closely covering the case since it began — a “bail on appeal” motion was filed on Tory’s behalf in Los Angeles at the end of August, with a hearing set for September 5.

“Ask and ye shall receive: Tory Lanez’s lawyers appear to have filed a motion to bail him out of jail as he appeals his judgment and sentence for shooting Megan Thee Stallion,” Cuniff wrote on Twitter.

She added: “Regarding actual motion, DA’s office says they weren’t aware anything was filed and haven’t received anything yet, but ‘132 has been dark’ which refers to Judge Herriford’s dept # and means he’s been out. But public docket entry is yesterday, hearing is scheduled for Tuesday.”

Another motion for bail pending appeal was filed earlier this month, and at the time, Cuniff speculated that Lanez wouldn’t get his request granted, since the motion was similar to the ones that were previously rejected.

“The arguments are nearly identical to the motion Judge Herriford rejected at the Sept. 14 hearing in LA (the one where Lanez called me a googly eyed bitch), including the forgoing of any mention of the rehab pushed at sentencing,” she wrote.

As part of his bail preference, Lanez requested to rent a home in Los Angeles under house arrest rather than attending rehab.

“Instead of residential rehab, Lanez wants to rent a home in Los Angeles from a friend who rents exotic homes and cars,” she continued. “But his letter from the friend isn’t specifically about the bail request. It’s a general character reference letter for Lanez’s sentencing back in August.”

Tory Lanez is currently being housed at North Kern State Prison in Delano, California.
