Jazz music legend Michael Henderson is suing both Snoop Dogg and Murs and 9th Wonder for illegally using a sample of his music without the proper legal clearance.
Henderson, who has performed alongside the likes of Miles Davis, claims Snoop used a sample from his 1979 album Do It All for the song “Flashback” and the Warzone cut “Hands On the Wheel.” In a separate suit, Henderson is also claiming that 9th Wonder and Murs illegally sampled him on their song “3:16 Pt. 2.”
Henderson is asking that the court award him statutory damages for the infringement and any profits made by the songs. He also wants the court to forbid the artists from further manufacturing, distributing and selling the works in question. Henderson’s full complaint can be found here.

Those musicians that sue artist just for sampling pieces of their songs are pathetic to me. If it didn’t make any money they wouldn’t care. Then they find out it is making lots of money so they want a piece. Just like at the beginning of hip-hop artists didn’t care about sampling until hip-hop started becoming very profitable. Then all of sudden they claim statutory damages. They are just made they are not as popular as the hip artists that are sampling their old work from a dead era of music.
in the beginning stages of hip hop. the only samples that were used were free samples that were used from break beat records. clearing samples has been around since before hip-hop. thats what publishing companies do ie, ASCAP & BMI. they have departments that all they do is listen for their artist work to appear on another piece of work by another artist not affiliated with their company.in most cases its the publishing company thats doing the sueing collecting money owed to thier artist. which means more money for them as well. just FYI. did’nt want you spreading that ignorance around

I think artists deserve to get paid when artists use their songs as samples, so a lawsuit if probably fair enough. However I have become interested in/copped music due to samples, so I think often it can be good enough for the artists just to get credited if not paid.
He can’t sue Murs and 9th cuz they gave that song out for free. It wasn’t on the album and they just let people have it. They made no profit from it therefore Michael Henderson can’t sue them for squat. Nice try greedy musician.

Im so mad about these sample laws because hiphop is sampling. That’s how it was created and that’s the sound. It came from people who could’nt afford instruments, so they looped vinal tracks over a drum beat. The first american born artform should have a little more recognition than it gets. And i don’t understand these old musicians getting so greedy over royalties, because at least with hiphop, their music can live on and remain relavant. Hiphop samples often introduce me to old music that i had no idea about, and then i end up becoming a fan of older musicians and looking into more of their material. I love sample based hiphop because there’s a feel and texture to it that you don’t get from Scott Storch’s bull shit beats. Why do you think people love Pete Rock, Dj Premier, Just Blaze, Rza, Dr. Dre, 9th Wonder, Green Lantern etc.? It’s because these producers have a deeper knowledge and love for music. These sample laws need to change because it’s bad enough that real hiphop doesn’t get played on the radio or tv, we need to protect the best artform in the world from dieing
These were all free mixtape tracks so Michael Henderson is in for a rude awakening when he realizes that these tracks didn’t generate any revenue.
