According to an counter complaint that was filed in Chicago on October 28, Kanye West entered into an agreement with a Chicago DJ and producer named Eric “E-Smoove” Miller to record for Miller’s Focus Music Group in 1995.

The agreement stated that Miller would own and control all of the master recordings that were created by Kanye at the time. After an initial lawsuit filed by Kanye to stop the release of any master recordings, Miller filed a counter suit for the amount of $10 million.

Kanye filed his suit back in August to avoid the possibility of Focus Music Groupreleasing the material.

Miller’s attorney Randolph Phifer stated that if the material was released that Kanye would have been properly compensated. “This is about rights. We would like this to end amicably our countersuit is our offense. It is not a war.”Phifer said of the suit.

E-Smoove is a well-known DJ from the Chicago area. He has been nominated for a 2001 Grammy for Sunshine Anderson’s single Heard It All Before. He has also done remixes for the likes of Michael and Janet Jackson.

“We have a right to distribute the masters and that’s what we want the court to determine,” says Phifer. “We don’t have anything against Kanye. We just want to make sure our client gets what is just.”
