President Obama Says He Prefers Jay-Z To Kanye West

Barack Obama makes his pick from The Throne, choosing Jay-Z over Kanye West.

President Barack Obama enjoyed a boost from the Hip Hop community during his 2008 presidential campaign, and has long been linked with Jay-Z, as well as other Hip Hop artists.

Prior to a pair of fundraisers, an interviewer for theatlantic.com managed to ask the President which emcee from The Throne he prefers: Kanye West or Jay-Z.

"Jay-Z," replied the President, before adding, "Although I like Kanye. He's a Chicago guy. Smart. He's very talented."

"Even though you called him a jackass?" asked the interviewer, citing a 2009 incident in which the President was caught on camera having some harsh words for Kanye after he took the spotlight from Taylor Swift at the MTV Video Music Awards.

"He is a jackass," retorted Obama, who added with a wink, "But he's talented."

Here's the complete statement: Let's put the faux "war against stay at home moms" to rest once and for all. As a mom I know that raising children is the hardest job there is. As a pundit, I know my words on CNN last night were poorly chosen. In response to Mitt Romney on the campaign trail referring to his wife as a better person to answer questions about women than he is, I was discussing his lack of a record on the plight of women's financial struggles. Here is my more fulsome view of the issues. As a partner in a firm full of women who work outside of the home as well as stay at home mothers, all with plenty of children, gender equality is not a talking point for me. It is an issue I live every day. I apologize to Ann Romney and anyone else who was offended. Let's declare peace in this phony war and go back to focus on the substance. This is not an apology. It is a declaration of war. As I pointed out earlier today, the piece to which Rosen links says that Ann Romney is not an "expert" on women, and essentially makes the claim that she can't speak for women because she was a stay-at-home mom. She says that gender equality isn't a talking point for her, but she also deems certain lifestyle choices disqualifying in terms of representing other women. This is no "phony war." It's a very real war, started by the left--and they're only declaring it "phony" now that their true feelings about women with whom they disagree politically are revealed. The question is whether the Obama campaign and the Democratic National Committee will apologize to Romney, and whether they will fire Rosen over this incident. Rosen has long been associated with the Obama team and the DNC, and her apology means virtually nothing considering that she's still defending the substance of the comments.

    A Quick Guide to Florida Homicide for the Trayvon Martin Case With the Florida State Attorneys Office charging George Zimmerman with second-degree murder for the shooting of Trayvon Martin, Breitbart.com has assembled a quick guide to Florida homicide law and self defense for our readers. Weve taken some complicated legal terms and explained them and tried to break them down so they make sense to non-lawyers. Heres what youand the jurors on the Martin case will need to know to understand arguments being made under Florida homicide law. Murder Under Florida Statute: In Florida, the second-degree homicide statute 782.04 is defined as: the unlawful killing of a human being, when perpetrated by any act imminently dangerous to another and evincing a depraved mind regardless of human life, although without any premeditated design to effect the death of any particular individual, is murder in the second degree and constitutes a felony of the first degree, punishable by imprisonment for a term of years not exceeding life. When prosecutors explain this to jurors, however, they will have to do so by breaking the law down into what lawyers call elements. A prosecutor must prove every single element of the charge beyond a reasonable doubt. An element is like an ingredient in a recipe. You dont have a chocolate chip cookie if you dont have all the ingredients. You may have the sugar and the cookie dough, but without the chocolate chips, you dont have a chocolate chip cookie. With murder, the prosecution must prove all of the elements of murder; otherwise they have a killing, but they do not have murder. That means even if they have some elements, but not allthey still dont have a murder conviction. Heres how it all breaks down. Common Law Murder: Under British Common Law-thats the basic, original framework for before they are revised-murder is defined as (1) the unlawful killing (2) of a human being (3) with malice. Malice is defined as committing an act (a) purposely, (b) knowingly or (c) recklessly. First Degree Murder: When one commits a murder purposely, it is considered first-degree, which, in Florida, is punishable by death. First-degree murder is most commonly referred to as premeditated murder. How long does one have to premeditate a murder for it to be considered first-degree? It could be a split second. If someone were to point a gun at someone and aim it at their heart instead of just shooting quickly, theyre in the premeditation zone. Second Degree Murder: When one commits a killing knowingly-meaning that they are acting with a conscious awareness that they are doing something that could end anothers life, then they are committing second degree murder. When one commits a killing recklessly, they are acting with a conscious disregard for another persons life-or they are acting in a way that could cause a substantial and unjustifiable risk to that person. In Florida, when one commits a killing knowingly or recklessly, he or she can also be charged with second-degree murder, which carries up to life in prison. Manslaughter in Florida: Lesser degrees of killings actually include third-degree murder (a special category in Florida, which is rare in other jurisdictions) and manslaughter. Under British Common Law, Voluntary manslaughter typically involves someone committing an intentional killing, but the charge is reduced from murder to manslaughter because a person has an excuse such as acting in the heat of passion. Acting in the heat of passion usually requires acting within moments of experiencing a shocking event without having time to cool or calm down. Involuntary manslaughter usually involves an unlawful killing committed with negligence. In Florida, manslaughter can be committed in three different ways: (1) Manslaughter by Act, which is committing an act that was neither excusable nor justified and ultimately resulted in the death of another person, (2) Manslaughter by Procurement, which involves persuading, inducing, or encouraging another person to commit an act that ends up resulting in the death of another person, and (3) Manslaughter by Culpable Negligence, which involves engaging in culpably negligent conduct that leads to the death of another person. In Florida, a manslaughter conviction can carry up to 15 years in prison. The Burden of Proof: In Florida, only a grand jury-thats a special panel of citizens convened by the prosecution to decide if charges are appropriate-can enable a prosecutor to file for first degree murder, and its much harder to prove at trial than second-degree. So, often times prosecutors will only charge a defendant with second-degree murder even if they think their actions fall under a first-degree murder theory. That means the prosecutors theory of the case may or may not involve George Zimmerman premeditating Martins death-or it may merely mean that they think he acted recklessly. Well find out when prosecutors make their opening statement on the first day of trial and we finally get to hear their theory of the case. Second degree murder isnt as hard to prove as second degree, but prosecutors still carry whats called the burden of proof, and in criminal law its a very high threshold. The state must prove second degree murder beyond any reasonable doubt. A reasonable doubt must be a doubt that comes from the evidence at trial; it cannot be an imaginary doubt or a doubt based on conjecture. Justifiable and Excusable Homicide in Florida as an Affirmative Defense: In the state of Florida under Statute 782.02, a person can justifiably use deadly force when a person is resisting any attempt to murder such person or to commit any felony upon him or upon or in any dwelling house in which such person shall be. That means a person can legally kill another person if they are defending themselves from anothers attempt to murder them. If they are in their own home then they have extra protection and can use deadline force to prevent an intruder from committing any felony upon them. This extra protection in ones home is known as the Castle Doctrine under Florida Statute 776.013. Under 776.013, a person who is not engaged in an unlawful activity and who is attacked in a place where he or she has a right to be has no duty to retreat. According to Florida law, that person has the right to stand his or her ground and meet force with force, including deadly force if he or she reasonably believes it is necessary to do so to prevent death or great bodily harm to himself or herself or another or to prevent the commission of a forcible felony. When a defendant uses self defense as a defense it is called an affirmative defense. That means the defendant is admitting they committed the act, but they are asserting because of unusual circumstances beyond their control they are innocent of committing a crime. In this case, the burden of proof is still on the prosecution, but the burden of production (which side must produce evidence) shifts to the defense, and the defense must prove by a preponderance (more likely than not, or by 51% likelihood) that they were in fact acting in self defense as described above. Sound complicated? The jurors in each murder case must be able to understand all of this law to make a fair decision for the defendant and the interests of the victim and the state. The Trayvon Martin Case and Florida Law: The Florida State Attorneys Office has charged George Zimmerman with second-degree murder. Therefore, the prosecutors must prove beyond a reasonable doubt that Zimmerman knowingly or recklessly killed Martin, and they can only prevail if Zimmerman does not successfully assert one of many defenses, the most likely being justifiable or excusable homicide. If, in fact, the prosecutors cannot prove second-degree murder, Florida law allows prosecutors to ask jurors to convict a defendant of a lesser degree killing such as third-degree murder or manslaughter. Either way, prosecutors will have to prove the elements of every offense beyond a reasonable doubt.

    Eric Holder Silent on New Black Panthers' Racial Discord Americans must ask themselves whether Eric Holder and black leaders indeed fear the New Black Panther Party, as they all refuse to condemn their rhetoric and tactics in the last few weeks. The Trayvon Martin Case is the latest in a long list of incidents into which the New Black Panther Party has injected itself, but nothing has measured up to its latest tactics, which include placing a bounty on George Zimmermans head with the qualifier "dead or alive." It would seems to the most independent of observers that U.S. Attorney General Eric Holder, in his refusal to condemn this murder of hire scandal, approves the placement of bounties by private citizens on other private citizens. One would not have to wonder, if this had been a group of Americans connected with the Tea Party Movement offering up a bounty on a private citizen, what the reaction of the Justice Department would be. From the very start of the Obama Administration, it has seemed that Mr. Holder believes and believes in giving a great deal of latitude to the New Black Panther Party, as his department refused to entertain the very thought of prosecuting two members of the Party on charges of voter intimidation after they were video-taped by independent observers standing outside a Philadelphia polling place with billy clubs in hand. One would not need to wonder what Mr. Holder actions would be if a black voter called the Department of Justice and reported an empty police car sitting alongside the road leading to a polling place in Florida; there would be calls for him to launch investigations into voter intimidation from political and media figures. I also notice that none of the self-appointed black leaders such as Jesse Jackson and Al Sharpton publicly condemned the hate-filled rhetoric and murder-for-hire tactics of the New Black Panther Party, yet they boasted in the past to be the Keepers of the Legacy of Martin Luther King, who actively preached against the very violence that the New Black Panther Party called for in the wake of the Trayvon Martin Shooting and the investigation that lead to the arrest of George Zimmerman. Al Sharpton even boasted about a possible increase in civil disobedience if Mr. Zimmerman was not arrested before the Special Prosecutor had a chance to investigation the case and file charges against him. It would seem that President Obamas calls for civility in the wake of the Gabby Gifford shooting seemed to be lost on his number one ally in the black community in this case. Americans of all creeds should be concerned about the rhetoric and tactics coming from fringe groups like the New Black Panther Party, who claim its their main objective to use whatever resulting outcome in their tragic trial to foster racial discord. The question that most Americans need to be asking is, Does the Attorney General of our nation fear the New Black Panther Party, or does his silence along with those of the self-appointed black leaders indicate they approve of the group's rhetoric and tactics?

A half million dollars worth of Indian rosewood and ebony was seized under the premise that it had been imported illegally. The feds also took a number of guitars and computer hard drives. The factory was shut down for the day and employees told to go home. Yet after all this time, the Department of Justice has shown no sign that it will file criminal charges against Gibson. Whats more it has been almost 3 years since federal agents first raided Gibson (November 2009), seizing a quantity of wood from Madagascar. No decision on criminal charges in that case either.
